Terms and conditions

These terms are the agreement between you and ICIVA TECHNOLOGY, C.A. (RIF J-50142968-5), a company incorporated in the Bolivarian Republic of Venezuela ("we"). They have two parts: the Chui Learn app and the chuilearn.com website and the launch list. By using either, you accept these terms and our privacy policy.
The Chui Learn app
1. The service
Chui Learn is an app for learning Mandarin, with reading, writing, listening and pronunciation exercises, reviews scheduled with spaced repetition and game elements (streak, XP, jade, energy and relics). We may change, expand or remove features; if a change affects you significantly, we'll give you reasonable notice.
2. Minimum age
You must be at least 16 to use Chui Learn. The app asks for your date of birth when you create your account and doesn't let anyone under 16 sign up. If you are between 16 and the age of majority in your country, you confirm that your parent or legal guardian allows you to use the app.
3. Your account and your progress
You need an account to use the app, with email and password or with Google. You are responsible for keeping your access secure and for what is done with your account. Your progress syncs with your account: if you uninstall the app and sign in again, you get it back. The avatar and phone number in your profile are stored only on your device and are lost when you uninstall.
You can delete your account anytime in Settings → Privacy and security → Delete account. Your account and progress are permanently deleted; the privacy policy explains what is kept for a few days, such as backups.
4. Acceptable use
When using Chui Learn you agree not to:
- use the app for illegal or unauthorised purposes;
- try to access our servers, databases or services, or interfere with them;
- decompile the app or extract its code, except as the law expressly allows;
- use bots or automated methods to gain streak, XP, jade or other progress;
- send content that is illegal, offensive, harassing or that infringes other people's rights.
If you break these conditions we may suspend or close your account.
5. What you send us
You can send us suggestions, problem reports and vocabulary corrections. By doing so you give us a worldwide, non-exclusive, free permission to use and adapt that content to run and improve the app; for example, to apply your correction to everyone's vocabulary. We claim no other rights over what you write.
6. Free version, premium and in-game currency
Jade, XP, energy and streak protectors are earned by playing. They are not sold for real money today, have no monetary value and can't be exchanged or transferred. We may rebalance the game economy.
Today the app is free and shows no advertising. In the future we may offer a free version with advertising and a premium subscription without it, as well as other in-app purchases. They will go through the App Store or Google Play, under their own terms, and we'll update these terms and let you know in the app before turning them on.
7. Third-party services
Some features depend on outside providers: Supabase for accounts, Google for signing in with Google, Cloudflare for bot protection, Resend for emails, Sentry for errors and PostHog for usage data if you agree to it. We run pronunciation scoring ourselves. The privacy policy details what data each one receives.
8. Intellectual property
Chui, the character (its look, name, illustrations, animations, outfits, voice and personality), the "Chui Learn" name, the logo and the app's original content (text, illustrations, audio, music and code) belong to ICIVA TECHNOLOGY, C.A. or its licensors and are protected by intellectual property and trademark law. We give you a limited, personal, non-exclusive and revocable licence to use the app under these terms; it gives you no other rights over that content or our trademarks.
The vocabulary follows the official HSK 3.0 standard lists (GF 0025-2021). Dictionary definitions are based on CC-CEDICT, published under the Creative Commons Attribution-ShareAlike 4.0 licence, with our own translations and corrections. Those definitions, including our translations, may be reused under that same licence, crediting CC-CEDICT and Chui Learn; nothing in these terms about the app's content limits that right. If you believe any content in the app infringes your rights, write to [email protected] stating the work, where the content is in the app and your contact details. We'll review it and remove it where appropriate.
9. No warranties
The app is provided "as is" and "as available", to the extent the law allows. We do our best for it to work well and for its content to be correct, but we don't guarantee that it is error-free, that pronunciation scoring is always accurate or that what you learn is enough to pass the HSK or any other exam.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or use, arising from using the app or being unable to use it. Our total liability will not exceed the amount you paid us in the 12 months before the claim or, if you paid nothing, 50 US dollars. Nothing here limits liability that the law does not allow to be limited. [proposal, legal review]
11. Ending the agreement
You can stop using the app and delete your account whenever you like. We may suspend or close your account if you break these terms; except in serious cases or where the law prevents it, we'll warn you first.
12. If you downloaded the app from Apple's App Store
- This agreement is between you and us, not Apple. Apple is not responsible for the app or its content.
- The licence to use the app is limited to Apple devices you own or control, under the App Store's usage rules.
- We, not Apple, are responsible for maintaining and supporting the app. If the app fails to meet an applicable warranty, you can notify Apple, which will refund the purchase price, if any; Apple has no other warranty obligation.
- We, not Apple, will handle any claim about the app: product liability, failure to meet legal or regulatory requirements or consumer protection, or infringement of third parties' intellectual property rights.
- You must comply with any third-party terms that apply when using the app, such as your carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
The chuilearn.com website and the launch list
Joining the list is free and commits you to nothing. We'll let you know when the app is available, but we don't guarantee a specific date. You can unsubscribe anytime with the link in any email.
The site is provided for information. We do our best to keep it accurate, but details may change as the app evolves. Don't try to interfere with the site or the list, for example with automated sign-ups. The text, design and the Chui character on the site are protected just as in the app (section 8): you may not copy, modify or use them commercially without written permission.

Governing law and disputes
These terms are governed by the laws of the Bolivarian Republic of Venezuela. If you use the app or the site as a consumer from another country, you keep the protections that the laws of your country of residence guarantee you, and nothing in these terms limits them. Before any formal claim, write to us so we can try to resolve it amicably. Disputes will be submitted to the competent courts of Caracas, unless the law of your country lets you bring a claim before the courts where you live. [proposal, legal review]
Changes
We may update these terms. If the change is significant, we'll let you know in the app or by email before it takes effect. If you keep using the app after that date, you accept the new terms; if you don't agree, you can delete your account.
Other provisions
If any part of these terms is invalid, the rest remains in force. Not exercising a right doesn't mean we waive it. You may not assign this agreement without our written permission.
